Fabricated abortion is a term used in forensic medicine and medical jurisprudence. It refers to a situation where a woman who has been assaulted falsely claims or exaggerates that the assault caused her to abort (miscarry) a pregnancy, in order to strengthen or inflate the criminal charge against her assailant.
To support the fabricated claim, the woman may present:
A menstrual blood clot (passed off as aborted material)
A human fetus (obtained from another source)
An animal fetus (manipulated to resemble a human fetus)
Classic Case Example
A famous illustrative case: A woman alleged she had been assaulted while pregnant and had aborted as a result. The "products of abortion" she submitted for examination turned out to be a dog fetus - its forelegs and tail had been clipped off and the remains bottled to disguise it.
Medical Examiner's Role
Doctors must be on guard against fabricated abortions. Key points:
The doctor should carefully examine any aborted material for species identification
If direct trauma to the uterus did occur, the cause-and-effect relationship between trauma and abortion can only be considered probable when examination of the aborted material reveals no anomaly
All findings should be documented carefully as they may be presented as medico-legal evidence
