Dead Born - Definition (Gautam Biswas, 36th Edition)

From The Essentials of Forensic Medicine and Toxicology by Gautam Biswas:
DEAD BIRTH (IUD - Intra Uterine Death of fetus): A dead born child is one which has died in utero, and shows one of the following signs after it is completely born:

Signs of Dead Birth:

  1. Rigor mortis - Presence of rigor mortis at delivery.
  2. Maceration - A process of aseptic autolysis; the usual change. This occurs when the dead child remains in the uterus for about 3 or 4 days, surrounded by liquor amnii but with exclusion of air.
    • If air enters the liquor amnii after death of the fetus, putrefaction occurs instead of maceration.
    • Earliest signs of maceration: Reddening or brownish-pink color of skin with peeling and slippage, seen within 12 hours after death of the child in utero.

Key Distinction: Stillborn vs. Dead Born

Gautam Biswas draws a clear distinction between the two:
FeatureStillbornDead Born
When death occursDuring the process of birth (intrapartum)In utero (before labor begins)
Gestational age thresholdAfter 28 weeksNot specified
SignsNo breathing or signs of life after complete birthRigor mortis or maceration present at delivery
Condition at birthBorn in sterile conditionShows post-mortem changes
In medico-legal practice, determining whether a child was stillborn or dead born is one of the key questions (along with viability and live birth) that must be answered in cases of suspected infanticide.
