Here is a complete overview of the Medical Termination of Pregnancy (MTP) Amendment Act, 2021:
Medical Termination of Pregnancy (MTP) Amendment Act, 2021
(No. 8 of 2021 - came into force 24 September 2021)
The MTP Act was originally enacted in 1971 to regulate termination of pregnancy by registered medical practitioners. The 2021 amendment is the second major revision, making abortion more accessible for vulnerable categories of women.
Key Changes Introduced by the 2021 Amendment
1. Revised Gestational Limits
| Gestational Age | Requirements (Post-2021) |
|---|
| Up to 20 weeks | Opinion of one RMP sufficient |
| 20-24 weeks | Opinion of two RMPs required; only for special categories of women |
| Beyond 24 weeks | No gestation limit IF substantial fetal abnormality - requires Medical Board approval |
(Prior to 2021, the upper limit was 20 weeks for almost all cases.)
2. Special Categories of Women (eligible up to 24 weeks) - Rule 3B
The following 7 categories of women can now seek termination up to 24 weeks:
- (a) Survivors of sexual assault, rape, or incest
- (b) Minors
- (c) Women whose marital status changed during pregnancy (widowhood, divorce)
- (d) Women with physical disabilities (major disability under RPD Act, 2016)
- (e) Mentally ill women, including those with mental retardation
- (f) Women with a fetal malformation incompatible with life or likely to result in serious physical/mental handicap
- (g) Women in humanitarian settings, disaster, or emergency situations
3. Unmarried Women Included
Contraceptive failure as a ground for termination was previously limited to married women and their husbands. The 2021 amendment extended this to unmarried women as well - recognizing equal reproductive autonomy regardless of marital status.
4. Medical Board Constitution
Every State/UT Government must now constitute a Medical Board comprising:
- A Gynecologist
- A Pediatrician
- A Radiologist/Sonologist
- Other members as notified by the State Government
The Board approves late-term terminations (beyond 24 weeks) in cases of substantial fetal abnormalities - eliminating the need for women to approach courts.
5. New Provider Category
MBBS doctors with defined training and experience are now approved to perform MTPs up to 9 weeks using the Medical Method of Abortion (MMA - Mifepristone + Misoprostol). This expands service availability to lower-level facilities.
6. Confidentiality (New Section 5A)
A new provision was inserted making the identity of the woman strictly confidential. No registered medical practitioner can reveal the identity of the woman except to a person authorized by law. Violation is punishable with imprisonment up to 1 year, or fine, or both.
Consent Rules
| Category | Consent Required |
|---|
| Adult woman (≥18 years) | Her own written consent only |
| Minor (<18 years) / Mentally ill woman | Consent of guardian required |
| Husband / Family | NOT legally required |
Approved Places for MTP (Section 4)
- Government hospitals
- Private clinics/hospitals approved by government with adequate facilities for aseptic surgery, emergency resuscitation, blood transfusion, and post-procedure care
